Санкції Європейського Союзу в контексті збройної агресії Російської Федерації проти України: правові засади запровадження та імплементаціїї

У статті запропоновано дещо змінити підходи щодо вивчення санкцій Європейського Союзу. Метою дослідження є доведення відповідності конституційним засадам Спільної зовнішньої та безпекової політики Європейського Союзу правових засад запровадження та імплементації санкцій – цілі, підстави та процедура – після початку збройної агресії Російської Федерації проти України. Для досягнення мети використовувалися загальні та спеціальні методи, зокрема аналіз і дедукція, формально-юридичний та логіко-правовий. Авторами проаналізовано дискусії науковців щодо певних аспектів правового регулювання санкцій ЄС; виявлено особливості правових актів, згідно з положеннями яких запроваджуються санкції ЄС; окреслено процедурні правила запровадження та імплементації санкцій ЄС та наведено приклади реалізації європейськими інституціями (Високий представник Європейського Союзу з питань закордонних справ і політики безпеки, Європейська Комісія, Робоча група радників із міжнародних відносин (RELEX)) власних повноважень у межах їхньої компетенції; розглянуто знакові для України правові акти Ради Європейського Союзу та Європейської Ради про обмежувальні заходи щодо дій, які підривають або загрожують територіальній цілісності, суверенітету та незалежності України. Крім цього, висловлено авторську позицію щодо розвитку санкційного законодавства України. У підсумку авторами виявлено взаємозв’язок принципів та цілей Спільної зовнішньої та безпекової політики Європейського Союзу з цілями, підставами та процедурою запровадження санкцій після початку збройної агресії Російської Федерації проти України.
