Патентування винаходів, створених з використанням штучного інтелекту: проблеми теорії та практики

У статті, на основі інструментів аналітики інтелектуальної власності, аналізу міжнародного та національного патентного законодавства, досліджено проблеми винахідництва винаходів, створених з використанням штучного інтелекту (ШІ): динаміку патентування, патентну активність у сфері технологій ШІ, проаналізовано особливості експертизи патентоздатності винаходів у різних юрисдикціях (ЄПВ, Німеччина, Китай, США, Японія) та судову практику з цієї проблеми. Розглянуто основні положення законопроекту “Про внесення змін до Закону України “Про охорону прав на винаходи і корисні моделі” щодо врегулювання відносин, які виникають щодо винаходів і корисних моделей, створених з використанням штучного інтелекту”. Зроблено висновок, що Закон України “Про охорону прав на винаходи і корисні моделі” виключає комп’ютерні програми із патентованих об’єктів. Рекомендовано імплементувати норми Керівництва ЄПК щодо винаходів, реалізованих на комп’ютері, у Правила складання, подання та розгляду заявки на винахід та заявки на корисну модель, які не відображають цих аспектів.
